Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of southvalleyequine.com (the “Site”) and the online forms, appointment requests, text-messaging program, and other online services made available by South Valley Equine (“South Valley Equine,” “we,” “us,” or “our”).

By using the Site, submitting a form, or opting in to our text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

These Terms cover the Site and our online communications. Veterinary services themselves are provided under the client agreements, treatment authorizations, estimates, and hospital policies you sign or receive when your horse is treated. If those documents conflict with these Terms regarding a particular service, those documents control.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to request an appointment, register as a client, or opt in to text messages. By doing so, you confirm that you meet this requirement and that the information you provide is accurate and complete.

The Site Does Not Provide Veterinary Advice

Content on the Site, including articles, service descriptions, seasonal reminders, and social media posts, is provided for general educational purposes. It is not veterinary advice and is not a substitute for examination and treatment of your horse by a licensed veterinarian.

Using the Site, sending us a message, or submitting a form does not create a veterinarian-client-patient relationship. That relationship is established only when a South Valley Equine veterinarian examines your horse or otherwise agrees to provide care in accordance with applicable state law.

If your horse is experiencing an emergency, do not use the Site or email. Call us directly at (801) 254-2333.

Appointment Requests and Online Forms

Submitting an appointment request, new-client form, or other form through the Site is a request, not a confirmed booking. Appointments are confirmed only when a member of our staff contacts you. We may decline or reschedule a request based on veterinarian availability, the nature of the case, geographic service area, or other reasonable factors.

You are responsible for the accuracy of the information you submit, including your contact details and information about your horse’s history and condition. Our veterinarians rely on that information in providing care.

Text Messaging Program

When you provide your mobile number and opt in, you agree to receive text messages from South Valley Equine about appointment scheduling and reminders, patient updates, results availability, billing, and other matters related to your horse’s care. Message frequency varies. Message and data rates may apply.

You can cancel at any time by replying STOP. You will receive one confirmation message and no further texts unless you opt in again. For assistance, reply HELP or call (801) 254-2333.

Text messages are not monitored around the clock and should not be used to report an emergency. Carriers are not liable for delayed or undelivered messages. Our handling of mobile numbers and opt-in information is described in our Privacy Policy.

Fees, Estimates, and Payment

Fees for veterinary services are set out in the estimate or treatment plan provided to you before or at the time of service and are subject to change based on your horse’s needs during treatment. Payment terms, deposits, and financing options are governed by the hospital policies provided to you when services are rendered.

If you make a payment through a link or portal on the Site, you authorize us and our payment processor to charge the payment method you provide for the amount due. Any pricing or service information on the Site is provided for general reference and may be corrected if in error.

Reviews, Testimonials, and Photos You Submit

You may have the opportunity to submit reviews, testimonials, comments, photos, or videos to us or on our social media channels (“Submissions”). You keep ownership of your Submissions. By providing a Submission for publication, you grant South Valley Equine a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and adapt it in connection with our practice, including on the Site and in marketing materials. You may ask us to stop using a Submission going forward, and we will do so where reasonably practical.

You confirm that you have the right to share any Submission, including the right to share images of any people or horses shown in it, and that it is not false, misleading, defamatory, or infringing. We may decline to publish or may remove any Submission at our discretion.

Photos and information you share privately with our staff as part of your horse’s care are not Submissions and are handled as medical records under our Privacy Policy.

Intellectual Property

The Site and its content, including text, photographs, graphics, logos, videos, and design, are owned by South Valley Equine or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your personal, non-commercial use. You may not copy, republish, sell, or otherwise exploit Site content, or use our name or logo, without our prior written permission. All rights not expressly granted are reserved.

Acceptable Use

You agree not to use the Site for any unlawful or fraudulent purpose; to submit false, misleading, or malicious information; to impersonate any person or misrepresent your relationship to a horse or its owner; to upload viruses or other harmful code, or to attempt unauthorized access to our systems or data; to scrape, harvest, or collect information from the Site or about other users; to interfere with the operation or security of the Site; or to harass, threaten, or abuse our staff. We may restrict or terminate your access to the Site or our online services if we reasonably believe you have violated these Terms.

Third-Party Websites and Services

The Site may link to third-party websites and services, such as online pharmacies, payment and financing portals, insurers, breed registries, laboratories, and social media platforms. We do not control these sites and are not responsible for their content, availability, or practices. A link does not imply our endorsement. Your use of third-party services is subject to their own terms and policies.

Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms. Please review it before providing information to us.

Electronic Communications

When you contact us electronically or use the Site, you consent to receive communications from us electronically, including by email and, if you have opted in, by text message. Electronic communications satisfy any legal requirement that communications be in writing, where permitted by law. Agreeing to these Terms does not by itself constitute consent to receive marketing messages where separate consent is required.

Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, South Valley Equine disclaims all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that any content is complete, accurate, or current. Equine veterinary knowledge evolves and every horse is different; nothing on the Site should be relied on in place of an examination by a veterinarian.

Nothing in this section limits any warranty or right that cannot lawfully be disclaimed, or affects the standard of care that applies to veterinary services we actually provide.

Limitation of Liability

To the fullest extent permitted by law, South Valley Equine and its owners, veterinarians, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site or our online services, including reliance on Site content, delayed or undelivered electronic communications, or unauthorized access to information transmitted through the Site.

This limitation applies only to the Site and online services. It does not limit liability that cannot lawfully be limited, and it does not apply to claims arising from veterinary services, which are governed by the agreements and hospital policies applicable to those services and by applicable law.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless South Valley Equine and its owners, veterinarians, employees, and agents from any third-party claims, damages, and reasonable costs (including attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or any Submission you provide that infringes another person’s rights.

Changes to These Terms

We may update these Terms from time to time. The current version will be posted on this page with its “Last Updated” date. Changes apply from the date they are posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

Governing Law

These Terms and any dispute relating to the Site are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Subject to any rights you have under applicable consumer-protection law, any legal action relating to these Terms or the Site will be brought in the state or federal courts located in Utah County, Utah, and you consent to the jurisdiction of those courts.

General

If any part of these Terms is found unenforceable, the remainder will continue in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and any agreements you sign with us for veterinary services, are the entire agreement between you and South Valley Equine regarding the Site. Section headings are for convenience only.
